THIS INDENTURE, made the Seventeenth day of April in the year of our LORD One Thousand Eight Hundred and Sixty One.
BETWEEN William Bywater of the City of Toronto in the County of York and Province of Canada, Builder of the FIRST PART:
Jane Bywater wife of the said party of the first part, of the SECOND PART:
and William Hucheson Sparrow of the said City of Toronto, Gentle of the THIRD PART:
Witnesseth, that the said party of the FIRST PART, for and in consideration of the sum of Two Hunder and thirty pounds of lawful money of Canada, to him by the said party of the third part in had well and truly paid, at or before the sealing and delivery of these presents (the receipt whereof is hereby acknowledged), hath granted, bargained, sold, released, conveyed and confirmed, and by these presents doth grant, bargain, sell, release, convey and confirm, unto the said party of the third part, his heirs and assigns, ALL and singular that certain parcel or tract of land and premises, situate, lying and being in the said City of Toronto being parts of Park lot number Seven and Park lot number Eight (formerly in the Township of York now in the said City of Toronto) which is designated and laid down on the Plan of Said Park lots numbers Seven and Eight made by Robert Lynn Provincial Land Surveyor as lot number SIXTY THREE on the East side of Bond Street and is butted and bounded as follows that is to say Commencing in the Easterly limit of said Bond Street at the distance on a course North sixteen degrees West of one-hundred and ninety three feet from the intersection of the said Easterly limit of Bond Street and the Northerly limit of Crookshank Street being the South East angle of the said lot number 63. THENCE following the same course forty six feet. THENCE North Seventy four degrees East parallel with Crookshank Street aforesaid one hundred and sixteen feet to a Lane. THENCE South sixteen degrees East parallel with Bond Street aforesaid forty six feet. THENCE South seventy four degrees West parallel with Crookshank Street aforesaid one hundred and sixteen feet to Bond Street aforesaid to place of beginning. Subject to a mortgage from the said William Bywater and Jane Bywater his wife to James McCutchon of the said City of Toronto, Esquire for a balance owing of One Hundred and Ninety three pounds four shillings of lawful money aforesaid with interest due thereon from the first day of November one thousand eight hundred and fifty seven and payable as therein set forth in said mortgage.
TOGETHER with all and singular the houses, outhouses, edifices, barns, stables, yards, gardens, orchards, trees, woods, underwoods, fences, ways, waters, water-courses, lights, liberties, privileges, easements, profits, commodities, emoluments, hereditaments and appurtenances whatsoever, to the said parcel or tract of land and premises belonging, or in anywise appertaining, of therewith demised, held, used, occupied and enjoyed, or taken or known as part or parcel thereof, and also the reversion or reversions, remainder and remainders, yearly and other rents, issues and profits thereof and of every part and parcel thereof; and all the estate, right, title, interest, inheritance, use, trust, property, profit, possession, claim and demand whatsoever, both at law and in equity of him the said party of the first part, in, to, out of, or upon the said lands and premises, and every part and parcel thereof, with their and every of their appurtenances: TO HAVE AND TO HOLD the same lands, tenements and hereditaments, and all and singular other…
